This can be a very touchy subject relating to marriage mostly because some people think that because someone asks you to sign one, they must think that the marriage is doomed to fail before it has even started.

Basically a prenuptial agreement is a written contract between two people that set the terms of assets, future earnings, property and potential division of everything including children if the marriage is later dissolved. It's definitely not one of the most romantic things, especially since your wedding vows state that you will be together and committed to each other FOREVER.

However, concerning reality in this day and age, nearly fifty percent of marriages end in divorce and if this is your second time around, then you already know how valuable something like a prenuptial agreement can be. If a marriage is dissolved and things can not be agreed upon between the people involved, then the decision of who gets what gets left up to the state. And really, who wants that?

Based on BURGELIJK WETBOEK (BW) principle, section 147, this prenuptial agreement should be made at the notary before the wedding, changing can be made as long as before the wedding take place, with condition, all of them who make this agreement must be attend, and the signatory, must be at present too, for sign this revision note. After the wedding, this agreement cannot be change anymore.

  • A lot of people dislike the legal agreement for relationship. For some case this agreement is really necessary.

  • The prenuptial agreement is for protect asset from LAW side, this is important, more over if one of you in condition marriage for the second time (and have child), so this agreement will settle property for the heirs, when the parent die or divorce.

  • By making this prenuptial agreement, is not means we don't love our partner, but more to show how much we care about marriage continuance it self.
